Implementing Data Protection Laws In KSA

The local laws and regulations for personal private information are hardening day after day globally.

Governments may have adopted different approaches for the Data Protection or Individual Privacy but all of them are stressing on the importance of electronic security.   

One recent example on the importance of controlling and processing personally identifiable information is the Kingdom of Saudi Arabia.

It has newly issued its first comprehensive national data protection law.  The Personal Data Protection Law will enter into force on March 23, 2022, and regulates the collection, processing and use of personal data in the Kingdom.

Organizations with operations in the Kingdom or those processing data of Saudi residents will have one year to comply with the new requirements.

Businesses should note several important requirements contained in the new law affecting different aspects for any Saudi resident – whether national or expat.

Those aspects are defined as below:  

  • Extraterritoriality: Any processing of Saudi resident data performed in the Kingdom or by entities located outside the Kingdom is subject to the law’s requirements.
  • Restrictions on Cross-Border Transfers: Transfers of data outside of the Kingdom may be made for limited explicit purposes, as set out in the law, or for “other purposes” subject to the forthcoming regulations. Even if the transfer falls into a permitted category, further conditions must be satisfied, including approval by the competent government authority, with exceptions granted on a case-by-case basis only.
  • Registration: Data controllers must register with SDAIA and pay an annual fee.
  • Consent: Consent is the primary legal basis for processing personal data and must be obtained in writing (subject to further requirements in the forthcoming regulations). Personal data may only be processed without consent in very limited circumstances.
  • Local Representative: Any foreign company without a legal presence in the Kingdom that processes the personal data of Saudi residents must appoint a local representative, licensed for that purpose. SDAIA will determine when this requirement will come into effect.
  • Sensitive Data: All sensitive personal data, which includes genetic, health, and credit and financial data, will now be governed under the new law, but will also be subject to further regulation. The law contemplates a process of “reconciliation” with existing data regimes implemented by other regulators in the Kingdom.
  • Breach Notification: Breaches, leakages, or other unauthorized access to personal data must be notified to SDAIA “immediately,” as well as to data subjects.
  • Records of Processing Activities: Data controllers must prepare and register data processing activities with SDAIA.
  • Criminal Penalties: The law contains criminal penalties, including up to two years’ imprisonment and fines of up to SAR 3 million (approximately USD 800,000). Administrative penalties may be imposed with higher fines.

It is recommended that all businesses operating in the Kingdom or processing the data of Saudi residents to start assessing their activities and security systems in preparation of the law’s implementation.

Unemployment Insurance In UAE And An Understanding Of The Scheme

Unemployment Insurance also called Job Loss Insurance is a type of insurance that pays the employees a certain amount of compensation in the event of job loss. This compensation can either be lumpsum or distributed over a limited period. Voluntarily quitting your job is not covered by Unemployment Insurance. The benefits offered by a job-loss insurance plan can highly depend on the insurer.  UAE has taken another big step by introducing the scheme “Unemployment Insurance” that is meant to protect the workers who lose their jobs. The ruler of Dubai announced on Twitter, that this scheme is to enhance the competitiveness of the labor market, provide a social umbrella for its workers and establish an environment for all.


The Scheme works for all public and private sector employees with an exemption for domestic workers, investors, temporary contract holders, under 18 employees, and retirees. The scheme will be mandatory and would take into effect by early 2023. If you are an insured worker in the UAE and unexpectedly lose your job, you will be given a cash package up to 60% of your basic salary up to a maximum of AED 20,000 as compensation under this scheme. This package would last until you find another job. This is a promising major reform with 85% of the population being foreign workers, until this reform job loss would mean leaving the country and coming back on a new visa to find another job and a financial drain. This could change now under the new Insurance scheme. When an individual secures another job, payment ceases. The cash support would be limited for a period until they find an alternative.

The premiums will vary from AED 40 to AED 100 annually to be borne by the employees. There would be an option to apply for higher insurance packages and the idea is to provide flexibility and have more choices.  Existing Insurers will be offering these packages and MOHRE (Ministry of Human Resources and Emiratisation) will oversee the entire exercise.

The United Arab Emirates, which consists of seven emirates, including Dubai and Abu Dhabi, has been enacting new labor rules to make it easier for foreign workers to work there.

Employees should have better confidence and security due to the new policy.

The new unemployment insurance plan will provide a blanket cover for the expatriates and Emirati employees in the UAE’s governmental and commercial sectors in the case of job loss, limiting the uncertainty and financial obligations in the country. The program is expected to assist in reducing the stress produced by unemployment. It will help unemployed people, preventing them from major stress whilst unemployed.    

The Government officials are working on the finalized framework to a few of the details that are still in the grey. These details would be released in the coming months.

 

Aetna International Enters Into A Deal With Allianz Partners

On March 23, 2022, CVS Health decided to pursue the plan to divest their IPMI business outside the Americas. As a result, Aetna International has signed a preferred partnership deal with Allianz Partners for the majority of their markets outside the Americas, Thailand and India. 

What does this mean in the Middle East?

Aetna International, in the EMEA and APAC regions, will no longer provide coverage for most new customers or renewals for most existing customers with policy renewal dates from July 1st, 2022 onwards for Group business and from November 1st, 2022 for Individual business. Aetna International intends to introduce their customers to Allianz Partners and to help migrate their membership to Allianz Partners at renewal. Completion of this migration process is planned to take place before or by October 31, 2023. 

This means that Aetna International IPMI customers will cease being on Aetna coverage by October 31, 2023 at the latest, apart from any claims they make on their Aetna International policy. The Thailand business will be acquired by Allianz Ayudhya in its entirety.
